General terms and conditions of sale
1. Scope of application
The following GTC apply to all orders placed with a consumer on our online store. A "consumer" is defined as "any natural person who is acting for purposes which are not part of his commercial, industrial, craft, liberal or agricultural activity"; a "professional" is defined as "any natural person or legal entity, public or private, who is acting for purposes which are part of his commercial, industrial, craft, liberal or agricultural activity, including when he is acting in the name of or on behalf of another professional".

The present GTC are applicable to the professionals also for the future commercial relations without that we have to mention it again. If the trader has deviating or supplementary general terms and conditions of business, their validity is hereby refuted; they shall only form part of the contract subject to our express agreement.

2. Contractual partners and conclusion of the contract
The sales contract is concluded with ZS2Radteile GmbH.

In accordance with the provisions of the Civil Code on the conclusion of online contracts, after viewing the details of your order, in particular the total price, you will have the opportunity to correct any errors. Then, when you click on the button allowing you to confirm your order and acknowledge your obligation to pay, the contract will be concluded.

3.contractual languages and storage of the contract text
The languages available for the conclusion of the contract are German, English and French.

We will save the contract text and send you the order data and our General Terms and Conditions by e-mail. You can view and download the terms and conditions on this page at any time. For security reasons, it is no longer possible for you to view your previous orders via the Internet/on our website.

4. Terms of delivery
Shipping costs are added to the prices of the products listed. Further information on the amount of the shipping costs is provided with the offers.

In principle, you have the option of picking up the goods at ZS2 Radteile GmbH, Unterbibracher Straße 3, 95519 Vorbach, Germany, during the following opening hours: Monday to Friday, 9:00 a.m. to 7:00 p.m.

Cash on delivery

You pay for the order directly on delivery.

Credit card

When placing the order, you provide us with your credit card information.

After confirmation of your status as a legitimate cardholder, we immediately ask the issuing institution of your card to proceed with the payment transaction after placing the order. The payment transaction is automatically carried out by said establishment and your card is debited.

PayPal

During the ordering process, you are directed to the site of the online service provider PayPal. In order to pay the invoice amount by PayPal, you must be registered there or register for the first time, authenticate your bank card information and confirm the payment order in our favor. After placing an order in the shop, we ask PayPal to process the payment transaction. Further information is available during the ordering process.

Immediately afterwards, the payment transaction is automatically carried out by PayPal.

6. Retention of title
We remain the owners of the goods until full payment has been made.

For professionals, the following additionally applies: we reserve ownership of the goods until full payment of all claims resulting from an existing business relationship. You are authorized to resell the goods subject to a retention of title clause in the context of regular commercial activities; you assign to us in advance all claims resulting from this resale – regardless of an assembly or mixing of said goods with a new product – up to the amount of the invoice and we accept this assignment. You are always entitled to collect the receivables, but we are also entitled to collect them ourselves if you do not meet your payment obligations.

7. Damage occurring during transport
This provision is applicable to consumers:

If goods are delivered with apparent damage, which occurred during transport, please make a complaint about the said defects as soon as possible to the delivery person and contact us without delay. The omission of a complaint or contact does not affect your legal rights and their satisfaction, in particular your rights to the guarantee. However, you help us to assert our own rights against the carrier or transport risk insurance.

This provision is applicable to professionals:

The risk of loss and accidental deterioration is transferred to you as soon as we have handed over the product to the freight forwarder, the carrier or another person or agency designated to carry out the delivery. Between merchants, the verification and complaint obligation regulated in Article 377 of the German Commercial Code (HGB) will apply. If you fail to make the required declaration, the product is deemed to have been accepted, unless there is a defect which was not visible on the date of the verification. This clause does not apply if we have fraudulently concealed a defect.

8. Warranties
Subject to the provisions below, the legal guarantee of conformity from which consumers benefit under articles L.217-4 and following of the Consumer Code applies.

Legal guarantee of conformity

The legal guarantee of conformity is provided for in articles L.217-4 and following of the consumer code.

Under the legal guarantee of conformity, we are required to respond to any lack of conformity of the goods sold existing at the time of delivery under the conditions of article L.217-4 of the Consumer Code. However, we are not bound by the public statements of the producer or his representative if we do not know them.

When acting as a legal guarantee of conformity, the consumer:

has a period of two years from the delivery of the property to act;
can choose between repairing or replacing the good, subject to the cost conditions provided for in article L. 211-9 of the consumer code;
is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods, except for goods acquired second-hand for which the initial period of 6 months is maintained.
The legal guarantee of conformity applies independently of any commercial guarantee granted.

The warranty against hidden defects

The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code within 2 years from the discovery of the defect. Under the legal warranty against hidden defects, we are required to respond to hidden defects in the thing sold which render it unfit for the use for which it is intended or which reduce this use so much that the buyer would not have acquired it or would have paid less if he had known them. In this case, the consumer can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.

For professionals, any claim under the guarantee of conformity must be notified by registered letter with acknowledgment of receipt to the address ZS 2Radteile GmbH - Unterbibracherstr. 3 - 95519 Vorbach - Germany, within one year of the sale. In this respect, it is specified that we are in no way responsible for the public declarations of the manufacturer or any other advertising message relating to the characteristics of the goods sold, only our own indications and the product descriptions of the manufacturer included in the contract being authentic.
